Which is exactly why Google included Term 10.8. Allowing use of the
static images in a non-browser application conflicts with the use of
their own Google Maps application, for example.

Google's server-side checking uses a number of data items which all
need to be supplied and consistent, and which are optimised for
browser use. (I'm not going to give any hints about how to circumvent
the security though, but you could search the group if you're
interested enough)
The reason why Group members tend to refer to the Terms first is that
they already somewhat constricting, and most people don't want them to
be made any more restrictive.
