I strongly disliked the way the Menu button was treated, too. For a while I tried to figure out a rule like the one you mention to allow me to use the button at least where it's available but after several failures we decided we couldn't afford using our users to test on the vast array of Android models and gave up. We display our own button instead. The app is worse for it but we couldn't see any other way.
I'm not saying there is no rule to figure out which form if any the Menu button takes on any specific device, just saying I tried and found none.

However, should I take the name too literally? Would a menu soft key that appears only in portrait be considered a "permanent" menu key? Would a "soft" key return a different answer than a "hard" key?
